ROME, Ga. — A Summerville man is facing a misdemeanor public indecency charge following an alleged incident in the parking lot of a Rome movie theater earlier this month.

Gary Lee Gilbert, 48, of Summerville, was arrested by the Rome Police Department on Wednesday, August 12, and charged with public indecency, first or second conviction, according to arrest information.


The charge stems from an alleged incident in the parking lot of Movies at Berry Square in Rome.


According to the arrest warrant, a movie theater employee was sitting inside her vehicle when she noticed another vehicle, allegedly driven by Gilbert, repeatedly circling the parking lot and her vehicle. The employee reportedly found the behavior unusual and began recording the activity with her cellphone.


Authorities allege Gilbert eventually parked his vehicle and got out while wearing a dress, bra, and thong. According to the warrant, Gilbert later removed some of the clothing. At the same time, in the parking lot, he then sat down and moved his dress upward, exposing his penis and scrotum to the theater employee who was nearby.


The alleged incident resulted in Gilbert being charged with misdemeanor public indecency.


Under Georgia law, public indecency generally involves certain prohibited sexual or intimate conduct in a public place. The specific charge listed in Gilbert’s arrest information is public indecency involving a first or second conviction and is classified as a misdemeanor.
