CEDAR BLUFF, Ala. - On Monday, February 20, Cedar Bluff Police department arrested 70-year-old John Green of Cedar Bluff for production of child pornography, possession of child pornography, and sexual abuse in the second-degree.
Green is now in custody at the Cherokee County Detention Centre in Centre, Alabama on six count of production of child pornography, six counts of possession of child pornography, and four counts of sexual abuse in the second-degree.
Production of child pornography is a Class B felony, in the state of Alabama the distribution of child pornography results in no less than two years up to twenty years in state prison and fines up to $10,000, per count. Where as sexual abuse in the second-degree is a Class A misdemeanor, the misdemeanor version carries up to a year in jail and up to $6,000, per count. If a person commits a second or subsequent offense of sexual abuse in the second-degree within one year of another sexual offense, the offense is a Class C felony, the punishment is from a minimum of one year and one day in prison to ten years in state prison with a maximum fine of $15.000, per count.
Green was also arrested back on February 9, for sodomy in the second-degree which is a class B felony, under Alabama law a person without prior convictions is looking at two to twenty years in state prison, per count. If the second-degree sodomy involved a child and was under the age of 12 the minimum sentence is ten years in state prison, per count.
All people are presumed innocent until found guilty and the penalties for the crimes are only for those found guilty.
